Terms of Use for the Neiv App

1. Overview

These Terms are a public offer to enter into a contract of adhesion between you and the developer of Neiv: the License section grants permission to use the app; the other sections set out the service terms. Apple is not a party to this contract; App Store purchases are also subject to Apple's separate terms. You can read and save the text before accepting; tapping “Accept Terms” accepts the displayed edition, while a separate checkbox records your agreement to the technical characteristics. Accepting these Terms, browsing the website or using free minutes does not start a paid subscription. Neiv is an informational navigation tool: its estimated position has an error margin and does not replace your attention, road signs or other sources of orientation. The app is intended for people aged 16 or over: drivers legally entitled to drive, or passengers who do not interfere with driving; the statutory rights of minors and other people remain protected. A person aged 16 to 18 has limited legal capacity, so a paid feature is taken out by the holder of the Apple account from which the purchase is made. 2. Who we are and how to contact us

The developer, licensor and personal data controller is Кирило Поліщук (Kiril Polishchuk), Kyiv, Ukraine, an individual developer. Confirmed full name, legal status, postal address, contact telephone number and additional details required for that status: Kiril Polishchuk, individual entrepreneur registered in Ukraine, tax ID 3811908712, 23B Sviatoslava Khorobroho St, apt. 53, Berdychiv, Zhytomyr Oblast, 13303, Ukraine, phone +380 97 277 47 44.

For relevant purchases in the Ukrainian App Store, the seller is Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Republic of Ireland. Payments go through Apple; the developer grants rights to the app. We are responsible for the app's operation, content and support. Apple has no obligation to provide maintenance or technical support for Neiv.

The neiv.app website provides information about the app, documents and programme entry forms. Each programme is governed by its published rules. Merely browsing the website does not constitute acceptance of new obligations or create a payment obligation.

3. What Neiv does and its limits

GPS is the primary source of position. When the signal disappears or becomes questionable, Neiv estimates the vehicle's position using its speed through an OBD adapter, the phone's gyroscope and a road graph. This dead reckoning is labelled DR. The result is an estimate, not a measurement with guaranteed accuracy. The assessment of GPS reliability can also be wrong.

The error may be metres, or tens of metres and more after an extended period without reliable GPS. This describes a possible scale of error, not a promised upper limit. The app can identify the wrong road, direction of travel or GPS reliability. We do not promise detection of every spoofed signal, a particular accuracy in metres or uninterrupted operation under all conditions.

Results depend on the vehicle and adapter, available signals, sensor accuracy, the phone's position and mounting, connection quality, the road, software versions and map coverage. The map and road graph may be incomplete or outdated, missing new closures, checkpoints, private access roads or height and weight restrictions. A route is a suggestion. A road appearing on the map does not establish that driving on it is permitted or safe.

Neiv is not an autonomous or assisted vehicle control system, an emergency service or certified professional navigation for aviation, maritime use or special-purpose vehicles. It is not a standalone detector of electronic warfare equipment and does not replace driver attention.

Maps and the road graph are prepared from mapping data and downloaded to the phone. Navigation calculations for a downloaded region run on the device. Downloads, updates, purchases and periodic verification of DR access require an internet connection. An offline map does not mean unlimited offline access to every feature; time limits are in section 8. This description does not remove your rights if the app fails to conform to the contract or the law.

4. Important characteristics for separate acceptance

Before you begin using the app, we separately display the following characteristics. The checkbox next to their description is not preselected and is separate from acceptance of the whole contract.

• Without reliable GPS, position is an estimate with an accumulating error and no guaranteed limit in metres; matching to a road can be wrong.
• DR depends on a third-party adapter, vehicle compatibility and available speed data; having a diagnostic port alone does not guarantee operation.
• Connections can drop and the app can close or restart; the position display can stop, and the initial position may need to be established again after a restart.
• The primary scenario is a mounted phone with its screen on. Background operation depends on iOS permissions and restrictions, power and temperature; uninterrupted background operation is not guaranteed.
• Free minutes are consumed while the relevant DR mode operates, including in the background and in “Check without GPS”; emergency minutes are not available for that check.
• Offline maps and road matching require downloaded regions. Outside available coverage, some functions are unavailable, and regional data may not reflect current road conditions.
• When trusted GPS returns, the estimate is corrected; the displayed position can jump.
• DR requires periodic online access verification; its display can stop when that verification or the cold-start offline allowance expires, even with maps already downloaded.

By selecting the separate checkbox, you agree to receive the feature with the specific characteristics described above. General acceptance of the Terms does not replace this agreement. It applies only to disclosed characteristics. It does not make every failure, unsafe behaviour or departure from what was promised acceptable, and does not remove statutory remedies.

Acceptance is stored on your device together with the version, time, language, text and list of separately accepted characteristics. The time comes from the device clock and is not an independently certified timestamp. You can save a copy from the Terms screen in the app.

5. Safety and driver responsibilities

Set up your phone, download regions and connect the adapter before driving. Secure the phone in a suitable holder; both the phone and adapter must be in the vehicle whose data is being used. Do not hold the phone or interact with its screen while driving. Stop safely before changing settings, reading documents or troubleshooting.

Watch the road. Glance at navigation only when it does not distract you from driving. Follow Ukraine's traffic rules, signs, road markings, traffic controllers and authorised officials regardless of Neiv's display. Do not use it as your sole source of navigation. The driver decides how to drive; the app does not control the vehicle and does not remove responsibility for traffic violations or their consequences.

Apple requires this notice for real-time navigation: YOUR USE OF THIS REAL TIME ROUTE GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE.

Ukrainian translation: ви використовуєте цей застосунок маршрутного ведення в реальному часі на власний ризик. Дані про місцеположення можуть бути неточними. This means that you assess road conditions and driving decisions yourself. The notice does not remove liability imposed on us by law or your mandatory rights.

Do not rely on Neiv for tasks requiring precise measurement of location, distance or heading where inaccurate, delayed or incomplete data could cause death, injury, property damage or environmental harm. If the display is doubtful, do not make a dangerous manoeuvre based solely on it.

Neiv is intended for civilian road navigation. Do not use it for military or intelligence tasks, combat control or weapon guidance. This requirement concerns the purpose of use, not a person's profession during a civilian journey. Observe lawful local traffic restrictions and curfews. A route is not an access permit. Do not transmit information about military or critical facilities or movements where prohibited by law. Neiv does not publish your tracks to other users; recordings are sent to the developer by your choice, and you must also check whether you are entitled to transmit that information.

6. Your vehicle and third-party equipment

DR requires a compatible iPhone, vehicle and OBD adapter, purchased separately. An OBD-II port, ELM327 label or Bluetooth capability does not guarantee iOS or Neiv compatibility. Check requirements and the adapter catalogue before purchasing a subscription, and test your equipment combination during free use, safely and before driving.

“Verified”, “Recommended”, “Not recommended” and “Incompatible” labels reflect our known experience and technical requirements. “Verified” refers to the stated test conditions. It is not a guarantee for every unit, firmware version or vehicle combination, or equipment certification.

The app receives data through diagnostic requests and supported bus-reading modes. It is not intended to control movement, change vehicle settings or reprogramme vehicle control units. We are not the manufacturer or seller of your adapter and provide no warranty for it.

Follow the vehicle and adapter manufacturers' instructions on connection, voltage, power and leaving the device in the port. A third-party device can drain the battery, cause an unstable connection or affect the vehicle's electronic control units. If unusual behaviour occurs, stop safely and follow the manufacturer's instructions.

Vehicle and adapter warranties and insurance cover are governed by their respective contracts and the law. We do not promise that any adapter will have no effect on them, and do not claim that connecting an adapter automatically cancels a warranty or insurance cover. Comply with applicable third-party terms; mobile data is charged under your own tariff. These provisions do not remove our responsibility for our own actions or the app.

7. License and open components

We grant you a public, non-exclusive, non-transferable license without sublicensing rights to install and use Neiv for its intended purpose on compatible Apple-branded devices that you own or control, as permitted by the Apple Media Services Usage Rules. The app may also be accessed and used by other accounts associated with the purchaser through Family Sharing, volume purchasing or Legacy Contacts, as permitted by Apple. Our usage rules do not conflict with the Apple Media Services Terms or applicable Volume Content Terms.

The license applies in Ukraine throughout lawful use under these Terms; access rights permitted by Apple and mandatory law remain protected. Basic use is free; paid features are available within the access you have purchased or been granted. Ownership of the software is not transferred. Rights to code and other materials belong to their respective rightsholders.

Do not copy, sell, distribute or modify the software beyond the license granted; do not decompile or reverse-engineer it except where expressly permitted by law or the applicable open license. Do not impersonate Neiv's developer. Do not bypass lawful payment protections, interfere with the service or use automated downloads to create a load that disrupts it. These restrictions do not remove rights to open data, including obtaining and using databases under ODbL.

We, not Apple, are responsible for investigating, defending, settling and discharging third-party claims that the app or your possession and use of it infringes their intellectual property rights.

8. Free minutes, subscriptions and refunds

Free access

Basic GPS navigation is free. DR requires a subscription or available free minutes. Neiv minutes are not an Apple trial subscription and do not automatically convert to a paid subscription. Payment arises only after a separate App Store purchase confirmation.

Starter minutes are consumed first, then weekly minutes. Reinstalling does not create entitlement to new starter or emergency minutes. Balances and deadlines are shown in the app. Minutes are consumed while the relevant DR mode operates, including in the background, rather than while you look at the screen. “Check without GPS” uses main minutes, not emergency minutes. The demo does not consume minutes. Once the available allowance is exhausted, the DR display may stop during a journey; basic functions that do not depend on it remain available.

Access verification

Verify access with an internet connection before travelling. For Apple subscriptions, ownership verification is valid for no more than 24 hours; for access we provide through a separate grant, the typical limit is up to 7 days; for free minutes, up to 24 hours from a signed server check. Current server parameters may set shorter limits; the current state is shown in the app. A cold start additionally imposes an offline allowance of up to 30 minutes, which may be shorter, including zero. This limits trust in time verification; it does not grant additional DR minutes. Without successful verification, DR can become unavailable despite valid payment and a downloaded map.

Your subscription works on all of your devices signed in to the same Apple account you bought it with: the entitlement is confirmed by a signed proof of purchase from Apple, so it works wherever you are signed in to that account. “Restore Purchases” brings the confirmation back on a new device and after a reinstall. We do not limit simultaneous use on several of your devices and do not require a transfer between them. If the subscription is not confirmed despite valid payment, contact [email protected]. This subscription does not support Apple Family Sharing; the app access rules in section 7 remain in effect.

Plans and charges

“Neiv DR Protection” offers monthly and annual auto-renewable subscriptions. Prices, currency, period and offer conditions are displayed on the subscription screen and before confirmation in the App Store. For users Apple determines to be eligible, an introductory offer provides 50% off the first monthly period once, followed by the full price. This discount does not apply to the annual plan. A referral discount applies under the programme rules and after confirmation of Apple's offer. Your bank may apply its own currency conversion rules and fees.

The subscription renews automatically until cancelled. Manage it in iPhone Settings → your name / Apple Account → Subscriptions, or at https://apps.apple.com/account/subscriptions. You can cancel auto-renewal at any time; to avoid the next charge, we recommend doing so at least 24 hours before the period ends, as Apple may start processing renewal earlier. Cancellation alone does not refund amounts already paid or end a duly paid period. Deleting Neiv, stopping journeys or an in-app block does not cancel the Apple subscription. Apple gives advance notice of price changes and obtains consent where required under its rules; you can cancel auto-renewal.

Withdrawal and statutory remedies

You have a right to withdraw from a distance contract within the period provided by law, including 14 days where that right applies. Starting a digital service before this period expires has only the consequences prescribed by law, and only when requirements for your consent and proper confirmation of information have been met. General acceptance of the Terms or tapping a purchase button does not waive all refund rights.

If the app or paid service fails to conform to the contract, you may request that it be brought into conformity, seek a price reduction, or withdraw and receive a refund in cases provided by Ukrainian consumer protection and digital services law. We accept these claims at [email protected]. Exhausting free minutes, using the app or cancelling auto-renewal does not remove those rights.

Apple processes App Store payment refunds: https://reportaproblem.apple.com. You can apply there without contacting us first. We do not reject a lawful claim about our service merely because payment went through Apple or Apple refused a refund. A legally due refund or price reduction is carried out within the time and in the manner required by law, without an additional fee from us.

9. Referrals and the creator programme

Referral rules are available before entry at https://neiv.app/referral. They define verification conditions, rewards and deadlines. A friend's activation provides 60 minutes; their subscription provides the referrer with 50% off a future unpaid monthly charge after 14 days of verification, subject to a limit of 10 credited friends. Discounts do not stack on a single purchase. Annual subscribers can accumulate a balance; using the discount requires a monthly plan and the relevant Apple offer. The counter alone does not change Apple's bill. Rewards provide access or a discount, are not money, cannot be exchanged for money and cannot be sold.

The creator programme is not open in this edition: we accept no entries and award nothing for videos. Its rules will be published separately before entry opens; the material requirements below apply from that moment.

We may change or end a programme for future participation by giving notice in its rules. This does not cancel legitimately earned rewards. For confirmed abuse, we may cancel an improperly obtained reward, explaining the reason and allowing review. An App Store rating or review is not required for access or a reward; a positive rating is not required. Do not use the programme to manipulate App Store charts, search or reviews.

Label a promotional video made for a bonus with “реклама” (“advertisement”) and disclose the incentive. Do not make unsupported accuracy, compatibility or safety claims. Submit only material you are entitled to transmit, with the necessary rights to music, images and other people's voices. Submitting a video permits assessment of the application; advertising reuse requires separate, voluntary permission. Accepting these Terms does not grant that permission. Neiv's developer organises the programme; Apple is not a sponsor and is not involved.

10. Your data

Processing rules, recipients, retention periods and your rights are described in the Privacy Policy: https://neiv.app/privacy. Accepting the Terms is not consent to every type of data collection. You separately choose whether to send data to improve the app, and can change that choice in Settings → Data and Privacy. Refusal does not remove purchased features.

“Send nothing” concerns voluntary improvement data but does not exclude technical connections for maps, purchases, access verification and service protection. Infrastructure providers, including Cloudflare, receive technical connection data, including IP addresses. Pseudonymous data is not necessarily anonymous. Website forms use Cloudflare Turnstile to protect against automated requests; its rules are at https://www.cloudflare.com/turnstile-privacy-policy/.

Before sending a connection passport, journey or video, review the displayed data contents and check your right to transmit them. For access, correction or deletion requests, contact [email protected]. We may ask only for information needed to handle the request securely.

11. Support, updates and service changes

We provide support at [email protected]; our response target is 5 working days. This is a target, not a guarantee for every reply; mandatory statutory deadlines remain in effect. We provide updates necessary to keep the app in conformity with the contract, including security updates, and notify you of them and the consequences of not installing them. If a problem is caused solely by not installing a properly supplied update after notice and instructions, the law governs the consequences.

Other changes are possible for a valid reason: changes in law or Apple requirements, removal of a confirmed security threat, loss of a necessary third-party component, or a justified technical service update. We explain the content and reason for changes. They do not add charges for an already paid period or permit arbitrary removal of access.

If a change negatively affects access or use and the effect is more than minor, we provide advance notice that can be saved and reproduced unchanged, describing the change, date and withdrawal method. You may withdraw without charge within 30 days of receiving the notice or the actual change, whichever is later. This right does not arise on that basis if you can continue using the previous, unchanged version without extra payment and it conforms to the contract and law. Any legally due refund is determined by law.

The current app supports remote DR disabling and a minimum-version requirement. Outdated builds can lose access. For a confirmed security threat or mandatory legal requirement, we may immediately restrict the relevant feature or require an update; the scope and duration must be proportionate to the reason. We will explain the reason, consequences and next steps as soon as possible. This does not remove rights concerning an undelivered service.

We give advance notice of planned discontinuation of support or the service. For a paid service, we provide the proper access until the period ends or address a refund through Apple while preserving our statutory obligations. Service closure alone does not cancel auto-renewal.

12. Warranties and liability

Neiv is provided “as is” and “as available” to the extent permitted by Ukrainian law. We give no additional warranties of absolute accuracy, continuity, error-free operation or suitability for military, autonomous or emergency-rescue tasks. This does not exclude mandatory quality and safety requirements or conformity with our contractual promises.

We are responsible for applicable warranties. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund its purchase price. To the maximum extent permitted by law, Apple has no other warranty obligations for the app; other related claims, losses, liabilities, damages, costs and expenses are our responsibility. This does not limit separate statutory rights concerning the paid subscription.

We, not Apple, address user and third-party claims about the app and its possession or use, including product liability, compliance with legal requirements, consumer protection, privacy and similar claims. Liability is determined by law, taking into account the circumstances, causal connection and established amount of damage.

Liability for accidents, fines, vehicle damage or lost data, time or profit does not arise merely from using Neiv; grounds and extent of compensation are determined by law. These Terms do not limit liability for intentional breach, harm to life or health, or other cases where liability cannot legally be limited. Free access does not remove non-waivable rights; the contract does not take rights away from third parties who did not enter into it.

Extraordinary and unavoidable events, including military action, GNSS jamming or spoofing, electronic warfare or government action, may affect liability only to the extent their effect on the particular breach is established and the law permits it. Martial law, GPS absence or failures by Apple, Cloudflare or an operator do not by themselves provide automatic exemption. We give notice of the impact and take available steps to reduce its consequences; termination and refund rights for undelivered services remain protected.

13. Ending use and restricting access

You may stop using and delete the app. Cancel the subscription separately through Apple. We may restrict an installation on the server for confirmed payment circumvention, interference with service protections, unlawful use or another material breach of these Terms. If it can be remedied and there is no urgent threat, we first notify you and allow a reasonable time to remedy it. An urgent threat may justify immediate restriction followed by notice.

The notice explains the reason, consequences and review process. If the restriction was mistaken, we restore proper access and address the undelivered service as required by law. A complaint, refund request or refusal of voluntary data sharing is not a breach. Simply declining new obligations does not cancel already paid access without a proper procedure.

After termination, you retain rights regarding payments, personal data and obtaining content you supplied or created to the extent required by law. Non-personal content that must be returned is provided on request free of charge, without hindrance, in a commonly used machine-readable format within a reasonable time, subject to statutory exceptions. The absence of an export button does not remove these rights. Contact [email protected] or [email protected].

14. Governing law, disputes and Apple rules

The contract is governed by Ukrainian law without removing protection under mandatory rules that apply regardless of the choice of law. Your relationship with Apple is governed by its separate terms: https://www.apple.com/legal/internet-services/itunes/ua/terms.html. Availability in the Ukrainian App Store does not permit violations of the law where Neiv is used.

We ask you first to describe the problem and desired resolution to [email protected]. This is voluntary and does not limit access to Apple, Ukraine's State Service on Food Safety and Consumer Protection, another competent authority or a court. Jurisdiction, time limits and court-fee exemptions are determined by law.

You represent and warrant that you are not located in a region subject to a U.S. Government embargo or designated by the U.S. Government as a terrorist-supporting region, and are not listed on any U.S. Government list of prohibited or restricted parties. Comply with applicable Ukrainian sanctions and export control rules; do not use Neiv to evade those restrictions.

You and we acknowledge that Apple and its subsidiaries are third-party beneficiaries of this contract. Upon your acceptance, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary. Apple is not responsible for our app or its content in our place; this does not change Apple's obligations under its own contracts or the law.

15. Language, new editions and history

The Ukrainian edition is authoritative and prevails over the English translation in case of discrepancy. English is provided for convenience. This does not restrict statutory information or translation rights. If a provision is invalid, the rest remains effective insofar as the contract can exist without it; ambiguities are interpreted in accordance with Ukrainian consumer protection law.

Each edition has a date and version. History and a copy of this edition: https://neiv.app/terms/2026-09-21/. We give in-app notice of planned material changes to rights or obligations at least 30 days before they apply, with an explanation on the website and a way to save the notice unchanged. This period does not apply to immediate measures required by law or needed to remove a confirmed security threat; we notify you as soon as possible about those measures.

Where consent to new terms is needed, we request it expressly before they apply. A journey or website visit alone is not consent. You may decline new terms, cancel auto-renewal and exercise applicable termination and refund rights. Changes do not retroactively worsen an already paid period or a legitimately granted reward. Editorial corrections that do not alter rights or obligations do not require new consent.
